1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
A. On April 7, 2014, the Plaintiff entered the Republic of Korea with a short-term visit (C-3) sojourn status on April 7, 2014, and applied for refugee recognition (hereinafter “instant application”) to the Defendant on October 16, 2017.
B. On September 20, 2018, the Defendant rendered a decision to recognize refugee status (hereinafter “instant disposition”) on the ground that the Plaintiff does not constitute a case where there is a well-founded fear that the Plaintiff would be subject to persecution” as a requirement of refugee under Article 1 of the Convention on the Status of Refugees and Article 1 of the Protocol on the Status of Refugees.
C. On September 28, 2018, the Plaintiff filed an objection with the Minister of Justice on September 28, 2018, but was dismissed on April 10, 2019.
[Reasons for Recognition] Unsatisfy, Gap evidence 1 to 3, Eul evidence 1 and 2, the purport of the whole pleadings
2. Whether the instant disposition is lawful
A. The gist of the Plaintiff’s assertion was that the Plaintiff was operating a mobile phone store in Pakistan, but around February 2014, the Plaintiff rejected the Plaintiff’s refusal to kill the Plaintiff if the Plaintiff did not subscribe to B, but the Plaintiff’s employees prevented the Plaintiff from taking advantage of the Plaintiff’s superior store. After that, around March 2014, the Plaintiff’s employees set fire to the Plaintiff’s superior store.
B Even after sending correspondence to the Plaintiff, it is threatening that the Plaintiff would kill the Plaintiff if the Plaintiff did not subscribe to B or would pay 10,000 US dollars.
Therefore, the instant disposition that did not recognize the Plaintiff as a refugee on a different premise is unlawful, inasmuch as there exists a well-founded fear that the Plaintiff would be subject to gambling in the event that the Plaintiff returned to the Republic of Pakistan.
B. Determination 1 is due to a well-founded fear of recognizing that a person is likely to be disadvantaged on the ground of race, religion, nationality, status as a member of a specific social group, or political opinion.
