A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On September 16, 2010, the Defendant was sentenced to imprisonment with prison labor for a violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (special rape) in the Gwangju District Court’s Net Branch on September 16, 201, and was ordered to attach an electronic tracking device (hereinafter “electronic device”) for five years and ten years, and completed the execution of the sentence in the Net Prison on June 29, 2015, and was equipped with an electronic device on the same day.

1. Violation of the Road Traffic Act;

A. On April 21, 2016, around 21:34, 2016, the Defendant driven a D low-speed car without obtaining a driver’s license in a section of about 500 meters from the nearby Do to the end of the Ycheon-si, the “Macroer” located in the Suncheon-si, Seocheon-si.

B. On June 1, 2016, around 07:10, the Defendant driven a e-car without obtaining a driver’s license from the front Do of light apartment at the time of the Suncheon-si to the front of the city of 100 meters from the Do to the front of the city of the city of the Suncheon-si.

C. On June 8, 2016, around 08:00, the Defendant driven an E Non-Stop car without obtaining a driver’s license in a section of approximately 200 meters in front of “G” located in the Net City F.

2. Violation of the Act on Probation and Electronic Monitoring, etc. of Specific Criminal Offenders;

A. On April 22, 2016, the Defendant received a warning from the head of the Gwangju Probation Office to the effect that “a person who operates a motor vehicle without obtaining a driver’s license shall comply with the direction and supervision of the probation officer, comply with the matters to be observed, and may be subject to disadvantageous disposition in the event of a violation” on April 22, 2016, the Defendant failed to comply with the direction and supervision of the probation officer by driving the motor vehicle without obtaining a driver’s license as prescribed in Article 1(1)(b) of the Act

As a result, the defendant, who was equipped with an electronic device, fails to comply with the direction and supervision of probation officers without justifiable grounds, is urged by the head of probation office to comply with the direction and supervision of probation officers again without justifiable grounds.
