1. The plaintiffs' claims against the defendants are all dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Basic facts
A. Korea Land Trust Co., Ltd. (hereinafter “Korea Land Trust”) is a company in which the government invested in full capital with the aim of contributing to the stabilization of people’s lives and the promotion of public welfare by building, supplying and managing housing and improving inferior housing. The Korea Land Trust Co., Ltd. (hereinafter “Korea Land Trust”) is a company in which the government invested the Korea Land and Housing Corporation, which received the National Housing Fund from from around 1999 to 200, constructed the rental apartment of Gwangju Northern-gu, Seoul Special Metropolitan City (hereinafter “instant rental apartment”) which constitutes publicly constructed rental housing, and thereafter leases the instant rental apartment to some Plaintiffs or existing lessees.
B. Defendant A purchased each real estate listed in the [Attachment Nos. 1 to 27 of the Plaintiff’s list from January 28, 2005 to September 30, 2005 from the Korea Land Trust, and completed the registration of ownership transfer, and is leased to the Plaintiffs listed in the [Attachment Nos. 1 to 27] of the same list.
C. On October 6, 2005 to February 16, 2006, the Defendant Company purchased each real estate listed in [Attachment Nos. 28 through 69 from the Korea Land Trust and completed the registration of ownership transfer from the Korea Land Trust, and is leased to the Plaintiffs listed in [Attachment Nos. 28 through 69].
The Plaintiffs, as indicated in the attached lease agreement sheet, have leased each of the real estate listed in the Plaintiff’s Schedule (hereinafter “each of the instant real estate”), part of the Plaintiffs’ real estate related to each of the Plaintiffs, “each of the instant apartment” or “relevant apartment”) from Defendant A or Defendant Company as indicated in the Plaintiff’s Schedule, and some of them (Attachment Nos 1, 5, 11, 35, 36, 53, 54, 65) were leased each of the relevant apartment from the Korea Land Trust from the Korea Land Trust, but the owner of each of the relevant apartment was changed to Defendant A or Defendant Company.
