A defendant shall be punished by imprisonment for one year.

Punishment of the crime

From August 2012, the Defendant has been engaged in the management office of the I building owned jointly by the victim C in the same building owned by the victim C in Sungnam-si, Sungnam-si, and the management office of the I building owned by the victim F (50% of shares), G (40% of shares), and H (10% of shares).

The Defendant, while taking charge of the above management duties, kept the K account passbook and L Bank M account passbook in the name of the victim C necessary for the receipt of rent and management expenses in relation to the D Building from the victim C, and kept the rent deposited into the above account by receiving respectively the J Bank N Account passbook in the name of the victim F and the L Bank O account passbook in the name of the victim F necessary for the receipt of rent and management expenses in relation to the I building from the victim F, and used the money as the expenses for the management of the building, and paid the profits accrued from the lease contract to the victims.

1. From September 26, 2012 to December 31, 2017, the Defendant used KRW 16,000 as management expenses and consumed KRW 4,00 for personal purposes while withdrawing KRW 20,000, out of the rent deposited in the account using the J bank K account passbook in the name of the victim C at the J Bank located in Seongbuk-gu P, Sungnam-si, the Defendant used KRW 173,913,465 in total over 175 times from that time to December 31, 2017.

Accordingly, the Defendant embezzled the victim C’s property.

2. From November 16, 2012 to January 14, 2018, the Defendant: (a) withdrawn KRW 300,000, which was deposited in the account using the J bank N account passbook in the name of the victim F at the J Bank in Sungnam-si P, Sungnam-si; and (b) consumed it for personal purposes.
