1. As to KRW 300,246,575 and KRW 300,00,000 among the Plaintiff, the Defendant shall pay to the Plaintiff the year from April 8, 2015 to May 28, 2015.
Reasons
1. Facts of recognition;
A. The Non-Party Korean Veterans Association (hereinafter “Non-Party Korean Veterans Association”) (hereinafter “Non-Party Korean Veterans Association”) concluded a contract of fidelity guarantee between the Plaintiff and the insured by setting the amount of insurance coverage amount to KRW 300 million, and the insurance period from March 2, 2012 to March 1, 2013, in order to secure the Plaintiff’s damage that the Defendant would incur by the Defendant’s unlawful act while employing the Defendant as an employee. The content of the contract is to compensate the Plaintiff for the direct damage to the property of the non-party organization suffered by the Defendant, who is the insured, by taking advantage of his/her position in the course of dealing with its business for the insured who is employed as the guarantor, or by taking advantage of his/her position during the insurance period, within the scope
B. In order to receive KRW 200,000,000 from the No.S. S. S. S. S. S. S. In order to work as B, the Defendant purchased oil on credit from the No.S. S. S.S.S.S.S.S.S.S.S. In order to sell it to the No.S.S.S.S.S.S. S.S.S.S.S.S.S.S.S.S.S.S.S.S. and submitted it to the No.S.S.S.S.S.S
C. However, on April 29, 2013, the non-party organization paid the oil price to the KCAB General and the KCAB Bank, which received oil due to credit, by subrogation of KRW 403,95,715.
On the other hand, the non-party organization dismissed the defendant on March 25, 2013 on the grounds of the defendant's breach of trust as above.
E. As a result of the Defendant’s breach of trust, the non-party organization claimed insurance money against the Plaintiff based on the above personal identity guarantee insurance policy, and the Plaintiff’s insurance money to the non-party organization on April 1, 2015 pursuant to the above personal identity guarantee insurance contract.
