A defendant shall be punished by imprisonment with prison labor for four months.

However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime

Any person who intends to conduct a motor vehicle management business shall register with the head of a Si/Gun/Gu as prescribed by Ordinance of the Ministry of Land, Infrastructure and Transport.

Nevertheless, on June 7, 2016, at around 16:20, the Defendant, without registering a motor vehicle management business, installed a iron bar and a tent roof on a size of about 30 square meters in the vicinity C located in Yeonsu-gu Incheon, Yeonsu-gu, Incheon, and operated a motor vehicle maintenance business which provides the borrower with paintss and various tools, etc. required for painting equipment, and operates a motor vehicle maintenance business which carries on a seal work at the bottom of the door-to-side surface to the right side of the vehicle.

Summary of Evidence

1. Article 79 of the Act applicable to the facts constituting the crime, Article 79 of the Automobile Management Act and Article 53 (1) of the same Act, the selection of punishment for imprisonment;

1. The Defendant, on the grounds of sentencing under Article 62-2 of the Social Service Order Criminal Act, has committed a second offense even though he/she had been punished for the same crime twice 2015 and once 2016, and thus, has been sentenced to imprisonment.

However, the defendant recognized the crime of this case, and the term of punishment shall be determined in consideration of the fact that the crime of this case was committed once, and the execution of the punishment shall be suspended.

In addition, in order to prevent recidivism, a social service order is given to the defendant.
