The sentence against the accused shall be determined by one year and six months of imprisonment.

However, the above sentence shall be executed for a period of three years from the date this judgment became final and conclusive.

Punishment of the crime

1. On May 18, 2017, the Defendant driven C Poter truck under the influence of alcohol level of 0.190% in alcohol level without a driver’s license, from the front side of a specialized agro-industrial complex located in the 1820 Gyeongnam Development Zone, to the front side of the C 468-10 located in the Gyeongnam Development Zone located in the 19:32 Gyeongnam Development Zone, while driving the C Poter truck under the influence of alcohol level of 0.190% in blood without a driver’s license.

2. On May 18, 2017, the Defendant: (a) while driving under the influence of alcohol on the road in front of Yancheon-gun, Yancheon-gun, Gancheon-do on the ground of the foregoing, the Defendant had the victim D (21) who was on the top of the Korean National Police Agency that was under the influence of drinking control and demanded the Defendant to stop the said cargo and then demand the Defendant to comply with the measurement of drinking; (b) had the Defendant escape; and (c) at the time of the crackdown on drinking control, the Defendant had the victim, who was in his/her seat by hand, 30 meters away from the above cargo, and caused the victim to suffer kne-free share on the left-hand side of the said cargo requiring approximately 2 weeks medical treatment.

Accordingly, the defendant carried dangerous articles and interfered with the police officer's legitimate execution of duties on the control of drinking driving and the maintenance of traffic order, thereby causing the injury to the police officer.
