A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for a period of four years from the date this judgment becomes final and conclusive.

Punishment of the crime

On September 22, 2016, the Defendant was a C-cab driver for business use belonging to Yong-Namnam Transit (ju), and the victim D (name, 23 years of age, leisure) was able to board the said taxi in the vicinity of F in Busan Jin-gu, Busan on September 22, 2016 and was able to go to G, and was under the influence of alcohol in the said taxi.

피고인은 같은 날 04:22 경 위 목적지에 도착하여 피해자를 깨웠으나 피해자가 일어나지 않자, 그 곳에서부터 택시를 운행하여 04:39 경 인도에 주차한 후 운전석과 조수석 사이로 몸을 돌려 한 손으로 피해자의 음부를 쓰다듬듯이 만진 다음, 피해자의 음부에 자신의 머리를 파묻고 피해자의 가슴을 만지고, 다시 택시를 운행하여 05:06 경 장소 불상 지에 정차한 후 자신의 모자를 벗고 몸을 피해자 쪽으로 돌려 피해자의 바지와 속옷을 내리고 피해자의 음부를 핥고, 피해자의 가슴을 만지고, 다시 택시를 운행하여 05:18 경 부산 사상구 H에 있는 I 교회 앞에 주차한 이후 운전석에서 내려 택시 뒷좌석으로 이동한 후 자신의 바지를 벗고 피해자에게 다가간 후 상체를 움직여 자신의 성기 부위를 피해자의 음부에 밀착시켜 삽입하려 하고, 2분 간 피해자의 몸 위에 올라 타 있다 피해자의 옆에 앉아 벗겨진 피해자의 양 다리를 세워 들었다가 다시 피해자의 음부에 자신의 손가락을 넣고 빼는 행위를 반복하였다.

As such, the Defendant had attempted to have sexual intercourse with the victim by taking advantage of the victim’s mental and physical loss.
