1. The remainder of each real estate listed in the separate sheet No. 1 put up for auction and deducts the auction cost from each proceeds of sale;
Reasons
1. Basic facts
A. The real estate listed in [Attachment 1 List No. 1 (hereinafter “instant land”) was owned by the Plaintiff and the Defendants’ mother-friendly G (hereinafter “the deceased”). On February 22, 2007, the Deceased transferred 3/10 of the instant land to Defendant B on the ground of donation made on February 21, 2017. The Deceased transferred May 28, 2010, the Deceased’s spouse and the Plaintiff and the Defendants’ spouse died on November 25, 2011, and through inheritance two or more occasions, the Plaintiff, Defendant D, E, and F acquired each of the instant land.
B. On August 7, 2013, Defendant F transferred 3.81/110 of the shares of Defendant F in the instant land to Defendant B on the grounds of sale on June 15, 2013, and Defendant E transferred 1.52/110 of the shares of Defendant E in the instant land on October 27, 2014, to Defendant B on the grounds of sale on October 24, 2014.
C. The real estate listed in [Attachment 1] No. 2 (hereinafter “instant building”) was owned by the Deceased, and is above A.
As described in Paragraph B, the deceased and H died on two occasions and through inheritance by division, each of the 2.75/13 shares in each of the instant buildings were acquired by Defendant B, Defendant D, E, F, and Defendant B, respectively.
Defendant F transferred 0.83/13 of the shares in Defendant F of the instant building to Defendant B on June 15, 2013. Defendant F transferred 0.83/13 of the shares in Defendant F of the instant building to Defendant B on October 27, 2014. Defendant E transferred 0.3/13 of the shares in Defendant E of the instant building on October 24, 2014.
E. The details of co-ownership as of the instant land and building (hereinafter collectively referred to as “instant real estate”) are as indicated in the indication of co-ownership shares in attached Table 2.
F. From May 28, 2010, the Plaintiff managed the instant building. Defendant D asserted that he changed the manager of the instant building to Defendant D with the consent of Defendant D, E, and F, a majority of the share in the instant building.
