A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 공무집행방해 피고인은 2015. 4. 20. 00:40경 인천 남구 C아파트 2동 203호 앞에서, “불상의 자가 문을 열려고 한다”는 내용의 112신고를 받고 출동한 인천남부경찰서 D지구대 소속 순경 E으로부터 다른 사람의 집에 들어가려는 이유에 대해서 질문받게 되자 자신의 집이라고 주장하면서 집 안으로 막무가내로 들어가려고 하였고, 이에 위 E이 피고인에게 다른 사람의 집이라는 점을 설명하면서 피고인을 가로막아 제지하려 하자 “씨발, 짭새 니들 뭐야”라고 욕설을 하면서 머리 부위로 위 E의 얼굴 부위를 들이받고, 주먹으로 E의 가슴 부위를 때리는 등 폭행을 가하여 경찰공무원의 정당한 직무집행을 방해하였다.

At around 01:10 on April 20, 2015, the Defendant damaged the gate used by the public office of the vehicle, who was arrested and accompanied by a flagrant offender for committing an offense as referred to in paragraph (1) at the entrance of the Incheon Southern Police Station located in Nam-gu Incheon Metropolitan City, Incheon, 290-ro 32, and who was arrested and accompanied by the crime as referred to in paragraph (1), thereby causing damage to the 352,00 won of the repair cost.
