A defendant shall be punished by imprisonment for four months.

Punishment of the crime

On March 27, 2014, the Defendant was sentenced to imprisonment with prison labor for a violation of the Punishment of Violences, etc. Act at the Daegu District Court on March 27, 2014 and two years of suspended execution for a period of one year and six months, which became final and conclusive on April 4, 2014, and is currently under suspended execution.

On March 3, 2013, the Defendant became aware of the victim B(the age of 21) with intellectual disability 1 in early 2013, and maintained a close relationship, and the Defendant, with the knowledge that the victim’s ability to determine right is somewhat lacking and that economic transaction concept was low, and used it to use C’s credit card, the mother of the victim who was in custody, was able to use it.

On April 9, 2014, the Defendant: (a) purchased goods or used services in total amounting to KRW 9,825,100 by using a new credit card or physical card in the name of C, such as a new credit card or physical card in the name of C, which was kept by a victim without understanding that the amount should be paid on the settlement date if he/she uses the credit card; and (b) purchased one half of the amount equivalent to KRW 4,50,000 in the market price, from that time to time, the Defendant used the credit card or physical card in the name of C, as shown in the list of crimes in the attached Table.

As a result, the defendant acquired a total amount of 9,825,100 won by using a mental disorder of the victim.
