Reasons
Punishment of the crime
1. On April 2, 2018, Defendant A leased the second and third floors among the buildings located in Songpa-gu Seoul Metropolitan Government D from the owner E and operated the mutual friendship with the trade name “F” in the above place from around the 9th of the same month, Defendant A subleted the third floor among the buildings on April 20, 2018 under the condition that the deposit amount of KRW 10 million would be KRW 4.5 million and the income of the second and third floors and the customers would be transferred from G.
From the time when the defendant leased the above place, the second and third floors of the above building are connected to the secret passage from the inside to the third floor of the second floor.
