1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Around June 2017, the Defendant: (a) conducted on-site investigations (from May 2015 to May 2016, and from January 2017 to March 2017, 2017) with respect to B hospital established and operated by the Plaintiff (hereinafter “instant hospital”); (b) determined that the instant hospital filed an unfair claim for KRW 90,224,520 in total of the medical care benefit costs as follows; and (c) determined that the instant hospital imposed a penalty surcharge in accordance with Article 98(1)1 and (5), and Article 99(1) and (8) of the former National Health Insurance Act (Amended by Act No. 1535, Mar. 27, 2018; Presidential Decree No. 2902, Jun. 26, 2018; hereinafter “instant disposition”) and imposed a penalty surcharge in accordance with the former Enforcement Decree of the National Health Insurance Act (amended by Presidential Decree No. 7075, Jul. 7, 20197).

In accordance with the standards for the establishment and approval of Article 3 of the Regulations on the Establishment and Operation of Special Medical Equipment - Paragraph (1) of Article 38 of the Medical Service Act and Article 3 of the Rules on the Establishment and Operation of Special Medical Equipment - At least one non-exclusive medical specialist in the film department shall be in charge of the quality control of medical equipment of special medical care, the overall control and supervision of the quality control of visual images, the evaluation of the cinematographic quality, and the reading of clinical images. However, C of the film department is in charge of the performance of the general management and supervision of the quality control of medical equipment of medical care - From May 12, 2014 to June 8, 2015; D from June 9, 2015 to February 29, 2016, without conducting overall control or supervision of the quality control of medical care equipment of the instant hospital, the video reading company has reported to the outside reading of the instant hospital or reported to the Ministry of Health and Welfare’s non-exclusive medical personnel - 90 - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - reporting.
