Examining the reasoning in light of the record, it is reasonable for the lower court to reverse the first instance judgment and to dismiss the Defendant on the ground that the res judicata effect of the summary order, which became final and conclusive as to the act of fraud 3 through 6 re-off of the crime list No. 1 in the instant facts charged, among the facts charged, extends to the above facts charged, and the lower court did not err by misapprehending the legal doctrine on the number of crimes in fraud, contrary to what is alleged in the grounds of appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
