A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant was appointed as a public educational official on April 26, 2005, and served as the head of the C elementary school administrative office in Ansan-si B from January 10, 2012 to December 31, 2013, and served as the head of the E elementary school administrative office in Pyeongtaek-si B from January 1, 2014 to June 30, 2016.

1. On September 13, 2012, the Defendant: (a) obtained approval from the head of a school from the head of the above C elementary school administrative office on the pretext that he/she purchased franchisp, which is school goods; (b) purchased an external hard disc, etc. equivalent to KRW 204,600, which is the Defendant’s personal goods, using a credit card of the C elementary school foundation (F) with access to the website; (c) obtained approval from the head of the school of the above C elementary school from the head of the school for the payment of the above franchis; and (d) embezzled the above credit card price of KRW 204,60 by transferring from the C elementary school accounting account to the C elementary school credit card settlement account (H) to December 20, 2013; and (d) embezzled the above credit card price of KRW 7,956,200,000 in total from the 25th of the attached Table of Crimes (1) to December 20, 2013.

2. On May 19, 2014, the Defendant: (a) obtained approval from the head of a school from the head of the above E elementary school administrative office on the pretext that he/she purchased a local flag in the above E elementary school administrative office; (b) purchased the Defendant’s personal belongings of KRW 307,800, using the credit card of the E elementary school juristic person (I) with access to the Internet site; and (c) embezzled by transferring KRW 307,800 from the E elementary school accounting account (J) to the E elementary school credit card settlement account (K) with the approval of the disbursement from the head of the school; and (b) obtained approval of the disbursement from the head of the school; and (c) embezzled by transferring the above credit card price of KRW 307,800 to the E elementary school credit card settlement account from February 29, 2016.
