1. The instant lawsuit shall be dismissed.
2. The costs of lawsuit are assessed against the Plaintiff, including the part resulting from the supplementary participation.
Reasons
1. Details of the decision on retrial;
A. The parties’ status intervenors are corporations that run sanitary management service business, etc. using approximately 300 full-time workers, and the Plaintiff is a person who was employed in the Intervenor on May 1, 2014 and worked as the chief of subdivision who performs the management work of the U.S.S. S. S. dollars.
B. On April 28, 2014, the Intervenor informed the Intervenor of the termination of the labor contract (hereinafter “instant cleaning services”) and the Korea Railroad Corporation and Dong Branch B (including C-D, E) railroad station cleaning services (hereinafter “instant cleaning services”).
(2) The Intervenor entered into a contract with respect to the instant cleaning service from May 1, 2014 to April 30, 2016, and extended the contract period on January 20, 2015 to May 31, 2016. (2) In order to perform the instant cleaning service, the Intervenor newly employed a majority of the workers belonging to the Dan&Tech Co., Ltd (hereinafter “N&C”) that provided the instant cleaning service before the Intervenor, and the Plaintiff was also employed for the aforementioned reasons.
3) The Intervenor entered into an employment contract with the Plaintiff from May 1, 2014 to April 1, 2016 (from April 1, 2015 to December 31, 2015) as follows (i.e., labor contract without entering into an employment contract).
The contract of each employment contract provides that the reasons for termination of the employment contract are as follows:
The term of the labor contract that is the date of the contract; from May 1, 2014 to December 1, 2016, 2016; or from February 1, 2016 to February 1, 2016 to February 1, 2016; or from January 1, 2015 to March 31, 2015; and from March 1, 2016 to March 31, 2016 to March 31, 2016; and
1. In case where Gap desired to retire, and has permitted it;
2. Where the contract is not renewed as the term of employment contract expires;
3. Where he/she is absent from office for at least five days;
4. Where he/she is unable to perform his/her duties due to mental or physical disability.
5. Where the relevant contract is terminated;
6. Where he reaches the retirement age.
7. Illegal collective action, attitudes, etc.;
