A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
1. Around March 19, 2020, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (Aggravated Punishment, etc. of Specific Crimes) (Aggravated Punishment, etc. of Specific Crimes, etc.) expressed that the Defendant was proceeding in front of the bus stops located in Bupyeong-gu Incheon Metropolitan City, Bupyeong-gu B, and that the victim C (the age of 50) would be “satisfing at any place or a vehicle at any place,” without any justifiable reason, at the seat of the said victim at one time.
Accordingly, the Defendant assaulted the driver of a vehicle in operation.
2. The Defendant of obstruction of performance of official duties against police officers E expressed his desire to “E, who is asked questions about the situation of the instant case from the Speaker E belonging to the F District 2 Team patrol team affiliated with the F District 2 Team, after receiving a report at the time and place specified in paragraph (1).” The Defendant assaulted the face of E one time on the right hand at the right hand.
Accordingly, the Defendant interfered with the legitimate execution of duties of police officers concerning the handling of 112 reported cases.
3. On March 6, 2020: (a) around 20:45, the Defendant was arrested as a flagrant offender suspected of violating the Act on the Aggravated Punishment, etc. of Specific Crimes (accidents, Violence, etc.); (b) an assistant C belonging to the above police station and H team; and (c) an assistant G belonging to the same team belonging to the victim, who was admitted to the metropolitan detention room at the request of the Defendant, and was admitted to the toilet with the above police officers at the request of the said police officers.
피고인은 같은 날 20:50경 위 화장실 내에서 위 피해자에게 “너네 죽여 버린다. 확 때려버릴까.”라고 협박하면서 오른쪽 발로 위 피해자의 왼쪽 정강이를 세게 1회 걷어찼다.
