A defendant shall be punished by imprisonment for four months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. The Defendant was the actual manager of D Co., Ltd. with the 10th floor of Gangnam-gu Seoul Metropolitan Building 10 floors and engaged in a comprehensive design business by employing 40 full-time workers.
As indicated in the attached Table No. 42, the Defendant is working in the company from February 1, 2012 to May 16, 2012, as shown in the attached Table No. 42.
A retired worker B did not pay the total of KRW 2,405,200 in April 2012, and KRW 2,757,590 in May 2012 without agreement between the parties on the extension of the due date for payment, within 14 days after the cause for the payment occurred.
2. The Defendant did not pay wages to E (201) from August 20, 2012 to January 23, 2013, KRW 5,830,00 in September 2012, KRW 5,830,00 in relation to retired workers E, and KRW 5,830,00 in October 2012, KRW 3,886,666 in November 2012, KRW 564,193 in December 2012, KRW 2,44,838 in total, KRW 18,55,697 in relation to the extension of payment period between the parties concerned, without any agreement on the extension of payment period between the parties.
3. The Defendant, as the representative of the fourth floor of the Gangnam-gu Seoul Metropolitan Government G Building, is an employer who operates a comprehensive construction business with ten full-time workers and employs ten full-time workers.
From June 29, 2009 to January 31, 201, the Defendant did not pay KRW 620,550 of the worker F retired while working in the company as of March 201, 201, KRW 633,140 of the worker F who retired, in April 2010, KRW 633,140 of the wage in May 201, KRW 716,696 of the wage in May 2010, KRW 934,821 of the year-end settlement, KRW 19,530 of the annual settlement refund, KRW 3,104,737 of the delayed payment, and KRW 5,225,52 of the said F’s retirement allowance within 14 days from the date when the grounds for payment arose without an agreement on the extension of the payment date between the parties concerned.
