A defendant shall be punished by imprisonment for five years.

A one kitchen (No. 13) which has been seized shall be confiscated.

Punishment of the crime

On March 20, 2008, the Defendant was released on November 30, 201, and the remaining term of imprisonment was expired on March 20, 201, when he was sentenced to imprisonment with prison labor for robbery, injury, etc. at the Gwangju High Court on March 20, 2008.

피고인은 2012. 9. 27. 03:27경 전남 강진군 강진읍 C 앞 노상에서 D 다이너스티 승용차를 운전하여 금품을 강취할 범행대상을 물색하던 중 피해자 E(여, 47세)이 핸드백을 어깨에 메고 귀가하는 것을 발견하고 위 피해자를 상대로 금품을 강취하기로 마음먹고, 미리 앞질러 피해자가 지나갈 것으로 예상되는 전남 강진군 F 인근에 위 승용차를 주차하고 그곳에서 약 30m 떨어진 골목길에 숨어 피해자를 기다리던 중, 같은 날 04:11경 위 ‘F’ 앞 노상을 피해자가 지나가자 미리 소지한 흉기인 부엌칼(칼날길이 20cm )을 들고 피해자의 등 뒤에서 달려들어 위 부엌칼을 피해자의 옆구리 부위에 들이대면서 ‘꼼짝 마, 움직이지 마’라고 협박하여 피해자의 반항을 억압한 후 피해자가 어깨에 메고 있던, 현금 40만원 상당, 통장 2개, 현금카드 등이 들어 있는 핸드백을 잡아당기고 피해자가 위 핸드백을 움켜쥐고 놓지 않자 강제로 잡아당겨 이를 가지고 가 강취하였다.
