1. Basic facts

A. The Plaintiff completed the registration of ownership transfer on November 21, 1984 as the receipt No. 44666, with respect to the 226m2 in Seoyang-gun G Yangyang-gun, Seoyangyang-gun, Yangyang-gun, the Plaintiff completed the registration of ownership transfer on the 2nd floor building on October 27, 1995 by the receipt No. 6065, and each of the above real property was owned by H and I on September 15, 2014.

B. 1) The Plaintiff between Yangyang-gun and Yangyang-gun on January 2009 and the Plaintiff’s land adjacent to the Plaintiff’s land (hereinafter “instant land”). The Plaintiff is a 11,175 square meters of land adjacent to the Plaintiff’s land.

(2) On July 25, 2011, the Minister of Land, Infrastructure and Transport notified the Plaintiff of an order to restore the land to its original state on July 25, 201, that “A part of the instant land, which was owned by the Do governor, was illegally installed as a photograph of the current status of illegal facilities, as it was installed on July 201, 201, on the following grounds: (a) from January 1, 2009 to December 31, 2013; and (b) the Minister of Land, Infrastructure and Transport voluntarily removed illegal facilities and buildings; and (c) the Minister of Land, Infrastructure and Transport notified the Plaintiff of an order to restore the original state.”

양양군은 2011. 11. 3. 원고에게 ‘건축법에 따른 건축신고 절차 없이 일반음식점(지상 1층, 경량철골/판넬잇기, 제2종 근린생활)을 무단으로 증축하여 원상복구 하도록 시정명령을 내렸으나 불이행하였다.’는 이유로 위반건축물에 대한 이행강제금 부과를 통지하였고, 2011. 11. 11. 원고에게 위 1)항의 대부계약 해지를 통보하였다. 다. 현재 이 사건 토지 위에 있는 건축물의 현황은 아래와 같다. 1) 이 사건 토지 중 별지 도면 표시 83, 84, 85, 86, 83의 각 점을 순차로 연결한 선내 (가)부분 35㎡ 지상에 파란지붕 판넬 조립식 건물[이하 ‘이 사건 (가)건물’이라 한다, 위 사진상의 ‘(가)데크하우스’를 지칭함]이 있다.
