All appeals filed by the defendant and prosecutor are dismissed.
Reasons
1. Summary of grounds for appeal;
A. Defendant 1) If an appeal is lawful as to the grounds for ex officio investigation, the court of appeals shall decide without any need to examine whether the grounds for appeal have been submitted, or whether the grounds for appeal are included in the statement of reasons for appeal. However, with respect to those other than the grounds for ex officio investigation, it may be the object of the trial only where the grounds for appeal were stated in the petition of appeal or are included in the statement of reasons for appeal submitted within the prescribed period. However, in exceptional cases where the grounds affecting the conclusion of the judgment are not included in the statement of reasons for appeal, it may be tried ex officio (see, e.g., Supreme Court Decision 2006Do8488, May 31, 2007). The Defendant, through his written opinion dated March 27, 2020, added the grounds for appeal to the purport that the arrest of the flagrant offender of this case was illegal arrest due to the arrest without notice, but the grounds for appeal submitted by the Defendant and the Defendant’s defense counsel did not contain the above contents within the period for submission of reasons for appeal, and the Defendant did not dispute the legality of the procedure of the first instance.
The defendant's above assertion cannot be viewed as a legitimate ground for appeal.
Furthermore, even if examining ex officio, according to the evidence duly adopted and examined by the court below and the court below, the defendant was dispatched to the police officer in the course of arresting him as a flagrant offender.
