The defendant shall be innocent.
Reasons
1. The facts charged in this case
A. On December 21, 2010, the Defendant had the mind to claim for the payment of false insurance proceeds without undergoing hospitalized treatment at “E Hospital” (hereinafter “E Hospital”) operated by D located in the Kuju-si, Seoul (hereinafter “E Hospital”).
Then, on January 11, 2011, the Defendant filed a claim for the payment of insurance proceeds against the victim M&C Co., Ltd., life insurance for the victim, the victim Samsung Life Insurance Co., Ltd., the victim Hyundai Marine Fire Insurance Co., Ltd., and the victim LIG damage insurance Co., Ltd. on January 12, 201, on the ground that on December 21, 2010 through January 10, 201, the Defendant was hospitalized into the “E Hospital” by suffering from injuries such as salt, tension, etc. on the 21st day from December 21, 2010 to January 10, 2011.
However, the Defendant continued to receive hospital treatment after receiving hospital treatment from December 21, 2010 to December 27, 2010.
The Defendant received KRW 3,959,100,00 from the victim life insurance company on January 12, 201; KRW 1,180,00 from the victim life insurance company on January 12, 201; KRW 360,000 on January 12, 201; KRW 74,550 on January 13, 201 from the victim Hyundai Marine Fire Insurance Co., Ltd.; KRW 74,550 on January 13, 201 from the victim Hyundai Marine Fire Insurance Co., Ltd.; KRW 53,53 from the victim LIG damage insurance company on January 17, 201; KRW 3,959,103, including KRW 420,00 on January 14, 201; and KRW 3,959,103, from the victim’s damage insurance company.
B. On January 28, 2011, the Defendant received medical treatment at the “E Hospital” without undergoing hospital treatment, with a view to claiming the payment of insurance money falsely.
Then, on February 18, 201, the Defendant, on February 18, 201, against the victim correctional life insurance company, the victim life insurance company and the victim Samsung life insurance company, and on February 22, 201, the victim damage insurance company.
