Reasons
1. The court's explanation on this part is the same as the corresponding part of the judgment of the court of first instance, except for the case where "if a lessee or a person who belongs to such household owns another house (if, however, if a lessee or a person who owns another house due to inevitable reasons, such as marriage, etc. owns another house, and disposes of the house in question within six months from the date he or she is notified of non-qualified person as a result of computer search)" as stated in Section 9 of the judgment of the court of first instance. Thus, this part is cited in accordance with the main sentence of Article 420 of the Civil Procedure
2. The assertion and judgment
A. According to the above facts, the instant contract was lawfully terminated by the Plaintiff on December 16, 2014 on the ground that the Defendant owned the Defendant’s house, and thus, the Defendant is obligated to deliver the instant house to the Plaintiff.
B. On this point, the defendant asserts that the defendant's father and wife married to the defendant at the time of acquiring the instant D house, and this is that it does not constitute a case where the lessee becomes the owner of another house during the lease period. However, while the housing problem is serious due to the rapid increase in the housing price in the urban area, there is a serious increase in the number of households that are unable to purchase the house due to the rapid increase in the housing price, it is necessary to efficiently manage the leased apartment in order to give more opportunities for stabilizing the Alley residential life and to preferentially receive benefits by selecting the households that are difficult to live and need to be protected, and it seems that it rather accords with the idea of fairness to give the new lessee who has no ability to purchase the house, rather than the existing lessee, who is capable of purchasing the house, to the extent that he or the members of the household have sufficient means to purchase the house.
