1. The defendant
A. Plaintiff A with respect to the share of 37.934/1,698.2/1,698, out of the area of 1,698 square meters in Suwon-si, Suwon-si, Suwon-si, Suwon-si.
Reasons
1. Basic facts
A. The share of 1334.62/1,698.2/1,698 among the land of this case in Suwon-si, Suwon-si (hereinafter “instant land”) was registered as the share of the site ownership of some sections of exclusive ownership of the land of this case (hereinafter “instant building”) constructed on each of the instant land on September 9, 201, with the share of 291/2/1,698.8/1,698 of the instant land.
B. On April 28, 2011, the Defendant acquired the ownership of the shares 66.12/1,698.2 (hereinafter “Defendant’s shares”) on which no right to a site is registered among the instant land, and completed the registration of ownership transfer on April 28, 201.
C. In addition, the Defendant filed a lawsuit seeking a registration of ownership transfer (U.S. District Court 201No. 85440m2) on the instant real estate (U.S.) and the instant second real estate (U.S. District Court 201No. 8540m2) on the ground of the exercise of the right to demand sale under Article 7 of the Act on the Ownership and Management of Condominium Buildings, against E, the owner of the real estate listed in paragraphs 1 and 2 of the attached Table No. 1 (hereinafter “the instant real estate No. 1 and 2”) on which the right to a site had not been registered among the instant buildings, and the Defendant completed the registration of ownership transfer on the instant real estate No. 1 and 2 on July 3, 2012.
Meanwhile, on October 18, 2012, a compulsory auction on the instant real estate Nos. 1 and 2 was commenced, and on April 17, 2014, Plaintiff A awarded a successful bid on the instant real estate No. 1 during the compulsory auction procedure on April 17, 2014 and completed the registration of ownership transfer on April 23, 2014. Plaintiff B awarded a successful bid on the instant real estate No. 2 during the said compulsory auction procedure on May 9, 2014 and completed the registration of ownership transfer on May 19, 2014.
