A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

No person other than a person handling narcotics shall possess, possess, use, transport, control, import, export, manufacture, prepare, administer, give or receive, trade, arrange for trade of, or provide psychotropic drugs.

The defendant is not a person who handles narcotics as a nationality foreigner of the Thailand.

1. The Defendant violated the Immigration Control Act, on November 11, 2017, was a married foreigner who entered the Republic of Korea as a short-term tourism visa (B-1) and was staying in Korea beyond the period of sojourn from around February 9, 2018 to around June 22, 2020 of the same month without obtaining permission for extension of the status of stay from the Minister of Justice.

2. Violation of the Narcotics Control Act;

A. At around 19:00 on January 15, 2020, the Defendant sold and purchased 0.2g of psychotropic drugs, upon receiving approximately 0.2g of psychotropic drugs, from 100,000 won, to E (F, suspension of indictment on July 8, 2020) at the Defendant’s room located in B (one name “D,” and suspension of indictment on July 8, 2020) at the Defendant’s room indicated in the preceding paragraph at around 18:00 on February 10, 2020.

3) On April 15, 2020, around 19:00, the Defendant sold and purchased 0.2g gramphones to G (one name “H” and suspension of indictment on July 8, 2020) at the Defendant’s room as indicated in Article 2-A(1).

4) On April 18, 2020, the Defendant, at around 18:00, sold and purchased 0.2 grams of phiphonephones from the Defendant’s room indicated in Article 2-A(1) to I (one name J, and suspension of indictment on July 8, 2020).

5) At around 21:00 on May 15, 2020, the Defendant: (a) received and sold 0.1g of philophones from N (O, under the police investigation) at the room of L (i.e., “M”, and indictment of detention on July 2, 2020) located in K on May 15, 2020; (b) obtained and sold 0.1g of philophones from N (O, under the police investigation). (b) The Defendant on May 15, 202 to K at the time of strike around 21:00.
