A defendant shall be punished by imprisonment for not less than eight months.

1. 112 신고 출동현장에서 범행 피고인은 2020. 9. 28. 21:35 경 창원시 마산 회원구 B에 있는 ‘C ’에서 술값을 지불하지 않는다는 112 신고를 받고 출동한 마산 동부 경찰서 D 지구대 소속 경장 E 등으로부터 귀가할 것을 요청 받자, 술에 취해 E에게 ‘ 씨 발 놈 아, 개새끼야 ’라고 욕설을 하면서 오른손으로 E의 가슴 부위를 1회 때린 다음 오른발로 E의 왼쪽 정강이를 1회 차고, 양손으로 E의 오른 팔을 수회 할퀴고, 계속하여 그 옆에서 피고인을 말리는 경장 F의 왼쪽 정강이를 발로 1회 찼다.

Accordingly, the Defendant interfered with the legitimate execution of duties by police officers concerning the handling of 112 reported cases.

2. 경찰서에서의 범행 피고인은 2020. 9. 28. 23:00 경 창원시 마산 회원구 합 성남 17길 56에 있는 마산 동부 경찰서 형 사과 사무실에서, 위 1 항 기재의 사유로 현행범 체포되어 온 후 술에 취해 피고인을 인치 중인 경장 F의 가슴 부위를 발로 1회 찼다.

Accordingly, the defendant interfered with legitimate execution of duties concerning the arrest of police officers in the act of committing a crime.
