1. The plaintiff's claim is dismissed.

1. Details of the disposition;

A. The Plaintiff was elected as a member of the Local Council B in 2018 (the proportional representative, the term of office from July 1, 2018 to June 30, 202), and C served as an assistant to the Plaintiff from November 2018 to October 2019.

B. On December 3, 2019, Internet media companies and local newspapers sent articles to the Plaintiff and C, including “D,” and on December 3, 2019, the Plaintiff submitted to the Special Committee on Ethics to resign from office as the chairperson and members of the Special Committee on Ethics (hereinafter “Special Committee on Ethics”) to which the Defendant belongs. On December 3, 2019, the Special Committee on Ethics appointed E members as new chairperson.

C. On December 5, 2019, the Defendant’s Speaker requested the Special Committee on Ethics to refer the Plaintiff’s “report on a person subject to disciplinary action” to the Special Committee on Ethics, and the said Special Committee on Ethics requested to convene an Ethical Investigation Advisory Committee on December 6, 2019, and notified the Plaintiff of the requirement that the Plaintiff be present at the Special Committee on Ethics because it was planned to examine the case of a member’s disciplinary action against the Plaintiff on December 10, 2019.

On December 9, 2019, the Ethics Investigation Advisory Committee submitted to the Special Ethics Committee a written advisory opinion stating that “it is reasonable to propose the plaintiff” after examining the agenda for disciplinary action against the plaintiff. On December 10, 2019, the Special Ethics Committee had C pay the common membership fees of KRW 80,000 per month, for which the plaintiff is obligated to pay, on which December 10, 2019, conducted disciplinary action against the plaintiff, and reported the same to the defendant. On December 11, 2019, the defendant made a resolution against the plaintiff at the plenary session.
