1. The defendant A shall be punished by imprisonment with prison labor for one year and six months;

Punishment of the crime

Defendant A was sentenced to ten months of imprisonment on August 14, 2014 with labor for a violation of the Petroleum and Petroleum Business Act, etc. at the source of water supply method on August 14, 2014, and completed the execution of the sentence on December 12, 2014 at the source of water supply and on two occasions, and was registered under the name of Defendant C, and is an operator of an I gas station whose business was registered under the name of Defendant C, K gas station whose business was registered under the name of J, and M gas station whose business was registered under the name of Defendant B, and Defendant B is a joint operator of the State gas station, and Defendant C is a person engaged in marina business.

1. Defendant A

A. Although a person who stores fake petroleum is not allowed to manufacture, store, or sell “fluor petroleum products” containing other petroleum products or carbons and hydrogen in a petroleum product, the Defendant established a gas station in the name of C, J, L, and had the Defendant manufacture, store, and sell “fluor petroleum products” at that place.

1) On May 6, 2015, the Defendant: (a) on May 6, 2015, at the I gas station located in Ischeon N, the Defendant stored, respectively, a fake petroleum 36 drum (1 drum, the same hereinafter) mixed with a substance containing approximately 70% of diesel and other petroleum products; and (b) a fake petroleum 37 drum in which other petroleum products than diesel are mixed with approximately 10% of them.

B) On June 26, 2015, the Defendant: (a) kept in the storage tank for automobile transit; (b) a fake petroleum 9 drum mixed with other petroleum products; (c) a fake petroleum mixture of about 95% with diesel and other petroleum products; and (d) a fake petroleum mixture of about 85% with diesel and other petroleum products; and (d) a fake petroleum mixture of approximately 15% with diesel and other petroleum products, respectively.

C) On August 13, 2015, the Defendant: (a) at the same place on August 13, 2015, in a storage tank for motor vehicles; (b) a fake petroleum 16 drum mixed with a substance containing approximately 85% of other petroleum products, carbon, and hydrogen; (c) a fake petroleum 4 drum mixed with a petroleum product different from light oil, and a petroleum product different from light oil is mixed with approximately 5%.
