1. The defendants are about 10,909,091 won and each of the above amounts to plaintiffs B, respectively, 16,363,636 won, plaintiffs C, D, E, and F.
Reasons
Basic Facts
Defendant G took charge of the management of I Station as the station leader of the I Station operated by Defendant Korea Railroad Corporation, and Defendant J took charge of the management of I Station staff and passenger guidance.
From May 15, 2009, the Defendant Korea Railroad Corporation (hereinafter “the instant construction”) proceeded with “Korea Railroad Corporation” in I Station.
Due to the instant construction, the platform No. 8 of the I Station (hereinafter “instant platform”) was installed in the same direction as the train’s moving direction. The distance from the pents to the safety line was narrow to the edge of the platform that the distance from the pents was 0.9m, and the distance from the pents to the pents was 2m wide.
The above platform of the I Station was a platform where the KTX trains, which start at the time of the I Station, had been waiting for a train from 30 minutes prior to the start of the ETX train, and had passengers board the train. However, on October 25, 2010, the train of 301, which started the I Station as of the end of the I Station, had been delayed for a period of one hour due to the breakdown, and the train of 304, which was scheduled to start from the platform of this case to 09:20 Seoul (the train of the above 301 trains arrive at the I Station) was also delayed from the start of the train of this case (the train of the passengers getting aboard and departing from Seoul).
In the situation of delayed arrival of trains, many passengers were waiting to board the platform of this case, and transfer passengers were in congested with the platform of this case, such as moving to board other trains.
On October 25, 2010, the network A is waiting in the platform of this case to board the train of 304 as well as Plaintiff F, a child, around 09:57. In order to get on the train of 304, the network A was waiting in the platform of this case. However, during the train of 301, the passengers, who were in the narrow platform of this case, were pushed off with the train of this case, after hearing the guide broadcasting that the train of this 301 enters the train and moved to the boarding location. The accident of this case (hereinafter referred to as the "accident of this case").
