A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant accepted a loan from a homeless employee who satisfies certain requirements, such as a certificate of employment and a pre-paid contract, to obtain a loan from a financial institution without any security, and to receive a loan from a first-hand “C,” etc. which is a blicker, and to pay for about 20% of the loan in the event that a pre-paid loan has become a blicker in the role of a false tenant.

On July 2, 2014, the Defendant: (a) on July 2, 2014, at a public brokerage office located in the Eunpyeong-gu Seoul Metropolitan Government D apartment shopping mall, the Defendant: (b) prepared a real estate lease agreement as if the Defendant leased KRW 130,000,000,000 to the Defendant for two years; (c) on July 16, 2014, the Defendant submitted the lease agreement and a certificate of employment that the Defendant works for the staff member in charge of the loan in the location as above at the Seodong-dong, Mapo-gu, Seoul Metropolitan Government (Seoul Metropolitan Government).

However, in fact, the Defendant did not rent the above H building 301 from F, and did not have worked for I at the time of the above loan application.

Nevertheless, on July 17, 2014, the Defendant was paid KRW 80 million to a national bank account (Account Number J) in the name of F under the name of a loan from the victim by deceiving the victim as above and deceiving the victim.

Accordingly, the Defendant received property by deceiving the victim in collusion with “C”, “F”, etc.
