피고인은 2014. 10. 31. 22:45경 고양시 덕양구 B에 있는 C 식당 내에서, 손님이 자고 있어서 퇴근을 못한다는 신고를 받고 출동한 경찰관 경위 D과 경사 E한테 자신의 말은 들어주지 않고 식당주인의 말만 듣고 편파적으로 일처리를 한다는 이유로 "병신새끼들, 지랄하고 자빠졌네, 씨발놈아, 좃만 한게"라고 식당주인 F가 있는 자리에서 공연히 위 경찰관들을 모욕하였다.
