The plaintiff's claim is dismissed.

Litigation costs shall be borne by the plaintiff.

1. Facts of recognition;

A. The Plaintiff is a person who served as the principal of the Defendant’s association from March 3, 2018 to August 18, 2019.

B. Parts relating to the president of the partnership in the rules of the defendant association (unnecessary parts omitted) are as follows:

Article 15 (Number of Officers and Right to Dispatch) The Union shall have one president, not less than four directors, and not more than two auditors.

Article 19 (Duties, etc. of Executives) (1) The head of an association shall represent the association, exercise overall control over its affairs, and preside over its general meetings, meetings of representatives and meetings

Article 21 (Remuneration, etc. of Officers and Employees) (1) The Cooperative may pay remunerations to full-time officers or part-time officers in accordance with the remuneration regulations separately set forth, and may pay expenses to be incurred by the officers in performing their duties.

Article 22 (Establishment of General Meeting) (1) Partnership shall hold a general meeting consisting of all members.

Article 23 (Resolution of General Meeting) (1) The following matters shall be determined through a resolution of the general meeting:

Article 29 (Establishment of Board of Directors) (1) A cooperative shall have the head of the cooperative and the board of directors composed of directors to execute its affairs.

(2) The president shall convene and preside over the board of directors.

Article 30 (Affairs of Board of Directors) The Board of Directors shall conduct the following affairs:

Matters delegated by the general meeting concerning the deliberation and decision of items to be presented to the general meeting for the execution of the budget and ordinary affairs of the association, and other matters necessary for the operation and implementation

C. Meanwhile, the remuneration regulations for executive officers and employees of the Defendant Union were enacted on August 18, 2019 through the resolution of the general meeting, and the details relating to the benefits are as follows.

VI.(The benefits of the president of the partnership and of the full-time officer) The amount of the president of the partnership shall be 3.5 million won per month.
