In light of the records, the court below’s decision of the court of first instance that found the Defendant guilty on the charge of taking property in breach of trust among the facts charged of this case on the grounds as stated in its reasoning is justifiable and it is not erroneous in the misapprehension of the bounds of the principle of free evaluation of evidence in violation of logical and empirical rules, or in the misapprehension of the legal principle as to illegal solicitation in the crime of taking property in breach of trust, contrary to the allegations

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
