A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 2. 공용물건손상 피고인은 2014. 6. 24. 10:30경 강릉시 가작로 277에 있는 행복예식장 앞 도로상에서 위 D지구대 소속 경찰관 경사 G, 경사 F이 피고인을 체포하여 조수석 뒤에 앉힌 것에 대해 화를 내면서, 위 경찰관들을 향하여 욕설을 하며 오른쪽 주먹으로 H 112순찰차의 조수석 뒷좌석 유리를 강하게 내리치는 방법으로 수리비 110,000원 상당이 들도록 유리창을 깨뜨려 손괴하고, 같은 날 11:00경 강릉시 C에 있는 강릉경찰서 D지구대에서 음주측정거부 혐의와 위 순찰차 손괴 혐의로 현행범 체포되어 조사를 받던 중 갑자기 화를 내면서 오른발로 주변 벽면에 설치되어 있던 벽면 콘센트를 걷어차 콘센트 케이스가 바닥에 떨어지게 하고, 재차 오른발로 출입문 벽면에 설치되어 있던 스텐 재질의 유리문 보호 기둥을 수회 걷어차 수리비 1,232,000원이 들도록 스텐 기둥이 움푹 들어가게 하였다.
