피고인은 2019. 10. 16. 12:28경 서울 관악구 B에 있는, ‘C편의점’에서 물품을 구입한 후 계산하는 과정에서 업주인 피해자 D(42세)이 카드 잔액이 부족하여 결제가 되지 않는다고 말하였다는 이유로 피해자에게 “개새끼, 사기꾼새끼, 씹새끼, 죽여버린다.” 등의 욕설을 하고, 자신의 카드를 피해자 앞 테이블에 던지고, 주먹을 들어 위협하는 등 피해자에 대한 증인신문과정에서 재생시청한 영상분 말미에 (1) 피고인이 피해자 가슴을 겨냥하고 카드를 던지는 장면이 확인되었으며, (2) 불분명하나 피해자 진술과 같이 피해자의 머리 부분을 툭툭 건드리는 듯한 장면도 확인되었으나, (1) 증인신문 전 공소사실 정리를 위하여 변호인과 함께 1회 공판기일에서 재생시청한 영상분(피고인은 한차례 실랑이를 한 뒤 잠시 자리를 떴다 다시 계산대 앞에 와서 실랑이를 하였는데 자리를 뜨기 전까지 장면만을 시청하였다)에 의하면, 피고인 주장대로 계산대에 카드를 던지고 주먹을 치켜드는 장면만이 확인되어 검사가 위와 같이 공소장변경신청을 하여 이 법원이 이를 허가하였고, (2) 폭행 부분은 영상 내용이 불분명하여 기소되지 아니한 이상, 피고인에게 유리하게 변경된 공소사실 대로 범죄사실을 인정한다.
