Reasons
Punishment of the crime
Defendant A (Defendant A, B, and C) is an actual operator of D Co., Ltd. in the Gunsan-si in which the business of manufacturing LED lighting fixtures is conducted, and Defendant B is an actual operator and director of Defendant C Co., Ltd. in the F in which the engineering work is conducted, Kim Jong-si.
1. Defendant A
A. When the Defendant came to know that the Korea Employment Agency for Persons with Disabilities provided subsidies to cover 75% of the expenses incurred in relation to the work facilities, etc. for employing persons with disabilities in order to establish a standardized workplace for persons with disabilities, he/she applied for subsidies with a lower amount than the actual construction expenses incurred in performing the construction work of the said workplace only with the subsidies without his/her own charges. In order to create evidentiary data as if the subsidies were normally used in the construction expenses, he/she was provided by the construction company with the construction specifications for the amount recovered from the construction company, received a partial refund after depositing the subsidies from the construction company ("one-one white paper"), and was willing to apply for the said subsidies by issuing false electronic tax invoices from the construction company as if the said amount was actually traded
On January 2019, the Defendant received a false construction statement from the above B on the ground that “A representative of C Co., Ltd. would issue the construction cost of KRW 424,00,000,000, as it is necessary to apply for subsidies,” despite the fact that the actual construction cost required for the construction of a factory in the middle order, was KRW 314,30,000,000.”
