1. The defendant shall be punished by imprisonment for a period of two years and six months;

2. Provided, That the above sentence shall be executed for three years from the date this judgment becomes final and conclusive;

Reasons

Punishment of the crime

Despite the fact that the Defendant is not a person handling narcotics, the Defendant dealt with the “JWH-018” or its similar body (i.e., “spha”, hereinafter “spha”) and marijuana as follows:

1. On November 2012, at around 21:00, the Defendant smoked in a way that: (a) around 21:00 on the first day of November 2012, the Defendant 3rd floor of the commercial building in Seoul, as D along with D; (b) less the beginning of the general tobacco smoke; (c) made two spins tobacco by inserting about 0.25 g of the spins that D had inside, and added the spins by inserting the spins.

2. At around 13:00 on the day following the date described in paragraph 1, the Defendant smoked with D, together with D, approximately 0.25 g of Sphas, in the manner described in paragraph 1.

3. On November 201, 2012, at around 20:00, the Defendant paid the SP 30,000 won to F along with D in the street in the E Station located in Mapo-gu Seoul, Mapo-gu, Seoul, and purchased SP 1g of SP.

4. At around 21:00 of the date stated in paragraph 3, the Defendant smoked with D, together with D, approximately 0.25 g of Sphas, in the manner described in paragraph 1.

5. At around 13:00 the day following the date indicated in paragraph 4, the Defendant smoked with D, together with D, approximately 0.25 g of Sphas, in the manner described in paragraph 1.

6. On November 201, 2012, around 20:00 on the date, the Defendant paid 30,000 won of the SP purchase price to F along with D in the street in the E Station located in Mapo-gu Seoul, Mapo-gu, Seoul, and purchased SP 1g of SP.

7. At around 21:00 of the date stated in paragraph 6, the Defendant smoked with D, together with D, approximately 0.25 g of Sphas, in the manner described in paragraph 1.

8. At around 13:00 the day following the date indicated in paragraph 7, the Defendant smoked with D, together with D, approximately 0.25 g of Sphas, in the manner described in paragraph 1.

9. The Defendant is the E station located in Mapo-gu Seoul Metropolitan Government around 20:00 on the first day of December 2012.
