The defendant shall be innocent.

1. The summary of the facts charged is a person operating a secondhand shop called “F” on the ground of Jeonyang-gun C, D, and E.

On May 2013, the Defendant purchased the land from Jeonyang-gun E, G, H, I, and J and conducted a land boundary survey. As a result of the survey, the Defendant became aware of the fact that part of the land is included in the said E land from around 18 years ago (M road, width of 4.7m between the K and L land, and approximately 30m price in length).

On July 2013, the Defendant: (a) installed a steel-frame fence on the ground above the ground and narrowed the width from 4.7m to 3m; (b) installed a gate at the end of the fence, thereby preventing a large number of unspecified vehicles such as N residents, such as N residents.

2. The crime of interference with general traffic under Article 185 of the Criminal Act is an offense under which the legal interest and protection of the traffic safety of the general public is the crime, and the term "landway" refers to a place of public use, namely, a place of public character where many and unspecified people or vehicles and horses are able to freely pass through without limiting a specific person, and the facts charged also refers to "the defendant has prevented vehicles from passing by many and unspecified persons."

Therefore, according to the health and evidence, as to whether the land roads as indicated in the facts charged (hereinafter “the road in this case”) fall under the category of obstruction of general traffic, the road in this case was used by the users of the former Y, H, I, and J land (including the two-story housing in the above land, and the M-type factory was operated until 15 years) and the users of the above N, P, Q Q land (the above land is currently used as the weekend farm around May 2006). The defendant purchased each land in the above G, H, I, I, and J under the name of R and removed the house in this case after removing the house in the above ground. Thus, it is recognized that only O used the road in this case other than the above O.
