1. The Defendants jointly share the Plaintiff KRW 36,989,808 and the Defendants B from September 26, 2016 to February 2, 2018.
Reasons
1. Basic facts
A. The Plaintiff is an insurer who entered into a fire insurance contract (hereinafter “instant insurance contract”) with E as the manager of the instant building as the insured with respect to the second floor building located D’s ground (hereinafter “instant building”).
B. Defendant B leased the first floor of the instant building to operate F Co., Ltd. (hereinafter “F”), and Defendant C Co., Ltd. (hereinafter “Defendant Co., Ltd”) is an insurer who concluded a fire insurance contract with Defendant B as the insured with regard to the leased part.
B. On July 4, 2016, around 14:38, a fire (hereinafter “instant fire”) occurred inside the F Rests of the first floor of the instant building, and the said resting room and outer wall board were destroyed by the fire fighters, etc., and the fire fighters destroyed the above building 1, the outside board of the second floor, and the windows of the second floor to extinguish the said fire, thereby causing damage to the second floor of the said building caused the fire.
C. As to the cause of the instant fire, in the House of Government Fire-Fighting, (i) as a result of the internal verification of the F Rest room, “the head of the F Rest finds a mt line from the front floor, appears to have been caused by electrical factors, and there is no other unique source of generation; and (ii) the National Scientific Research Institute, which assessed the above mt connection center, expressed its opinion that “the electrical advantages connected with the cause of the outbreak are not identified,” and (iii) in the Gyeonggi Northern Police Agency, the Scientific Investigation Team of the Korea National Police Agency, considering that there is no other unique source of generation, it appears that there is an electrical wires where the power source is applied, and that there is no other exceptional source of generation.”
The possibility of the outbreak of artificial situations seems to be low.
