1. 피고인들에 대한 폭력행위 등 처벌에 관한 법률위반( 공동 상해) 의 점 피고인들은 2017. 3. 31. 23:30 경 서울 구로구 I 앞 도로를 J, 성명 불상자( 일명 : K) 와 함께 지나가던 중 마침 그곳을 지나가던 피해자 L(37 세) 이 피고인들과 J, 성명 불상자( 일명 : K)에게 “ 짱 깨들은 싸가지가 없다” 고 말한 것에 화가 나 피고인 A은 주먹으로 피해자의 얼굴을 수회 때리고, 피고인 B은 피해자의 몸통과 팔을 잡아당기면서 피해자와 몸싸움을 벌이고, J 와 성명 불상자( 일명 : K) 는 주먹으로 피해자의 얼굴을 수회 때린 후, 피해자가 도망가자 피고인 A과 성명 불상자( 일명 : K) 는 피해자를 쫓아가 피해자를 바닥에 넘어뜨린 다음 발로 피해자의 얼굴을 차 피해자에게 이빨이 2개 깨지고, 코뼈가 부러지고, 입술이 찢어지는 등 치료 일수를 알 수 없는 상해를 가하였다.

2.
