A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On June 2013, the defendant established an agricultural partnership along with D introduced by a land owner on June 2013 to proceed with the business of supplying kimchi to the military forces, and the same year.

7. 10. Agricultural Partnership E was established.

1. In order to facilitate the loan of business funds necessary for the construction, etc. of kimchi factories from the lower order of 2013 to the first order of 2014, the Defendant and D agreed that D would increase the corporation’s capital by pretending that D lent KRW 600 million to the said agricultural partnership.

Accordingly, on January 19, 2014, the Defendant: (a) had F, a branch of F, write off one receipt with the issuer’s “A”; (b) “E”; (c) “D”; (d) “F”; (c) “The date of repayment; (d) January 30, 2014; (d) “the amount of borrowing money; (e) the date of issuance; and (e) October 17, 2013”; and (e) had F, affix the said corporate seal impression on the said receipt directly.

Even though the Defendant issued the above receipt under an agreement with D, the Defendant submitted as evidence a copy of the above receipt to the Defendant in the lawsuit of claim for construction price against the Defendant, and the Defendant did not know the existence of the above receipt at all and argued that the above receipt was forged.

Around January 2016, the Defendant: (a) forged a receipt in the name of A or an agricultural partnership E, a private document relating to rights and obligations, for the purpose of exercising D; (b) submitted it to the competent district court as evidence in the case of a claim for construction cost of No. 10563; and (c) attempted to acquire property or pecuniary benefits by deceiving the court.
