Punishment of the crime
The defendant of "2017 Highest 8346" is a user who runs a manufacturing business using nine full-time workers, who are the representative of D in the Nam-gu Incheon Metropolitan City C.
1. When a worker dies or retires, an employer in violation of the Labor Standards Act shall pay him/her wages, compensations, or other money or valuables within 14 days after the cause for such payment occurred;
Nevertheless, the Defendant provided labor between July 6, 2015 and September 2, 2015 to retired workers E, and did not pay the total of KRW 37,869,430 for seven retired workers, such as the above E, within 14 days from the date of each retirement without agreement on the extension of the payment date between the parties, as well as KRW 1,80,000, the amount of divided wage of August 2015, and KRW 780,000, the amount of divided wage of September 20, 2015, and KRW 37,420,000, the amount of wages for seven retired workers, such as the above E, in the attached list of crimes (section 9).
2. An employer who violates the Guarantee of Retirement Benefits of a worker shall pay a retirement allowance within fourteen days after the ground for such payment occurred, in case where the worker retires; and
