The defendant shall be innocent.

1. The part of the defendant in the separate criminal facts in the indictment of this case (retailing the suspect as the defendant) is the same as the defendant.

2. The prosecutor of the judgment applied Article 86 and Article 84 subparagraph 1 of the former Road Act (amended by Act No. 4545, Mar. 10, 193; Act No. 4920, Jan. 5, 1995; Act No. 4920, Jan. 5, 1995; Act No. 7832, Dec. 30, 2005; Act No. 86 and Article 83 (1) 2 of the former Road Act or Article 86 of the former Road Act (amended by Act No. 4545, Mar. 10, 1993; Act No. 4920, Jan. 5, 1995; Act No. 8661, Dec. 14, 2011; Act No. 8651, Feb. 15, 2015; Act No. 8677, Feb. 21, 2014>

Thus, the facts charged in this case constitute a case that does not constitute a crime, and thus, the defendant is acquitted under the former part of Article 325 of the Criminal Procedure Act.
