In light of the records, the court below's decision is just because the defendant's act constitutes a case where illegality is removed under Article 310 of the Criminal Act, and it is not guilty of the defendant's act, and it is not erroneous in the misapprehension of legal principles as to the grounds for the dismissal of illegality under Article 310 of the Criminal Act and the modification of indictment, or the omission of judgment.
