A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 특정범죄가중처벌등에관한법률위반(운전자폭행등) 피고인은 2013. 10. 5. 14:05경 서울 성북구 C에 있는 D중학교 앞에서 피해자 E(61세)이 운전하는 F 택시 뒷좌석에 탑승하여 같은 구 장위동 쪽으로 가던 중, 같은 날 14:15경 같은 동에 있는 ‘북서울 꿈의 숲’ 공원 앞길에서 목적지를 묻는 피해자에게 “빨리 가기나 해 이 씨발놈아, 빨리 안가면 죽여버리겠다”라고 욕을 하면서 운전석 의자를 발로 수회 걷어차고, 운행 중인 피해자의 옆구리를 발로 1회 걷어찼다.

Accordingly, the defendant assaulted the victim who is a driver of a vehicle in operation.

2. Definating;

A. At around 17:50 on October 26, 2013, the Defendant: (a) requested the victim J to return home to the Defendant at the center of Seongbuk-gu Seoul, Seongbuk-gu, Seoul; (b) the Defendant reported that the Defendant 112 was drunkly driven at the “H restaurant”; (c) the background leading up to the International District of the Seoul Sejong Cancer Police Station, which was called out by the Defendant; and (d) the Defendant’s J demanded the victim J to return home to the Defendant; and (d) the police officers, in the process where K and the residents of the said district are heard, are hearing the situation within which the said district group belongs and there is no drinking. As the police officers, “I am to go home, and scars are not aware of it. I am, and die. I am. I am, and die. I am even if I am to the house.”

B. On October 27, 2013, around 09:55, the Defendant publicly insultingd the victim by openly insulting the victim by stating that “M” in front of the “M” user in Seongbuk-gu Seoul, Seoul, demanded the victim N, who was called up after receiving a report from the above user 112, to return home to the Defendant by the Defendant. As the victim N, who belongs to the I district of the Seoul District Police Station, the Defendant: (a) the above user; (b) the state of the user; (c) the managementO; and (d) the developments leading up to the said district; and (c) the players are heard.”
