1. Details of the disposition;

A. On March 1, 1993, the deceased’s spouse B (hereinafter “the deceased”) changed the trade name to D Co., Ltd. (hereinafter “E Co., Ltd.”) and worked for D Co., Ltd. on March 1, 1993 (hereinafter “instant business establishment”). During the period from May 22, 2013 to 17:00, the deceased’s private person was found to have been dead in the multi-use room located adjacent to his home located on May 14, 2013.

B. On September 6, 2013, the Plaintiff asserted that the death of the deceased constitutes an occupational accident, and filed a claim for the payment of survivors’ benefits and funeral expenses with the Defendant. However, on December 16, 2013, the Defendant rendered a disposition on the payment of survivors’ benefits and funeral expenses (hereinafter “instant disposition”) against the Plaintiff according to a resolution of the Seoul Committee for Determination of Seoul Occupational Disease that it is difficult to recognize the death of the deceased as an occupational accident.

C. The Plaintiff filed a request for reexamination with the Industrial Accident Compensation Insurance Reexamination Committee on the instant disposition, but the said Committee dismissed the Plaintiff’s request for reexamination on May 2, 2014.

2. Whether the instant disposition is lawful

가. 원고의 주장 망인은 이 사건 사업장에 근무하는 동안 이 사건 사업장 대표이사로부터 전라도 사투리, 종교, 가족 등에 관하여 모욕적인 언사를 들었고, 높은 성과를 내었음에도 이에 합당한 대우를 받지 못하고 임원 승진에서 누락되었으며, F 프로젝트 업무에 참여하면서 성과에 대한 심한 중압감을 받았으며, 챌린지 그룹으로의 배치, 연구소장과 근태 문제로 인한 갈등 등을 겪으면서 지속적인 퇴사 압박에 시달리다가 우울증이 발병하거나 악화되어 자살에 이르렀으므로, 망인의 사망과 업무 사이에 상당인과관계가 인정됨에도 이와 다른 전제에 선 이 사건 처분은 위법하여 취소되어야 한다.
