A defendant shall be punished by imprisonment for two years.

Punishment of the crime

1. On September 2012, the Defendant would allow the victim C to have multi-household houses sold at the non-sceptic location of the Defendant during the middle of September 2012, 201, after completing multi-household houses in the next 32 square meters, if the Defendant planned to build multi-household houses in Gangseo-gun D while investing KRW 110 million in the site purchase and construction expenses.

“The purpose was to make a false statement.”

However, even if the defendant receives money from the injured party, he was thought to use it as interest repayment, living expenses, etc., and he did not intend to use it for the purchase of multi-household land and construction expenses.

The Defendant, as such, by deceiving the victim, received delivery of KRW 10 million from the victim on October 16, 2012.

2. On September 2012, the criminal defendant against the victim E would allow the victim E to purchase multi-household housing with 32 square meters after completing multi-household housing in the future when he/she planned to build multi-household housing in Gangseo-gun D while investing KRW 55 million in the site purchase and construction expenses.

“The purpose was to make a false statement.”

However, even if the defendant receives money from the injured party, he was thought to use it as interest repayment, living expenses, etc., and he did not intend to use it for the purchase of multi-household land and construction expenses.

The Defendant, as such, by deceiving the victim, received delivery of KRW 5 million on October 25, 2012 from the injured party.

3. On September 2012, the criminal defendant against the victim F made a false statement to the victim F, “If he/she plans to build multi-household houses in Pyeongtaek-gun D but invests KRW 55 million in the site purchase and construction expenses, he/she would thereafter be able to purchase multi-household houses with 32 square meters after completing multi-household houses later.”

However, even if the defendant receives money from the injured party, he shall pay interest on the loan.
