1. The judgment of the first instance, including the preliminary claim added to the damages for delay by this court, is as follows.

1. The following facts may be found either in dispute between the parties or in full view of the purport of the entire pleadings in each entry in Gap evidence 1 to 4 and Eul evidence 1 (including each number; hereinafter the same shall apply).

The plaintiff has its main office in Germany and is a company whose main business is technical advice and design related to industrial valves, export of various valves products, etc., and the defendant has its main office in the Republic of Korea and is a company specializing in the production, import, and supply of industrial valves.

B. On December 2, 2008, the Plaintiff and the Defendant entered into a contract for the provision of technology and services (hereinafter “instant contract”) with the following “A for ten years: (a) the Plaintiff provided the Defendant with technology and services related to the valve design, and the Defendant shall pay the service cost for the compensation for actual expenses (hereinafter “instant contract”).

After that, around June 2009, the Plaintiff and the Defendant entered into an additional agreement that sets the service cost under the instant contract as 25,000 per month, which is the monthly fixed amount base from the existing reimbursement standard.

The contents of “A” are as follows:

Technical operations - Customer cultivation analysis - process design and operation calculation of valves - selection of valves suitable for the most suitable type (internal structure) design and management equipment - technical preparation and pricing support for the establishment of prices and preparation of technology;

2. Composition of Business Activities - Technical frameworkization at customer offices - Technical hosting with customer C&I department - consulting (consultations) - Sticking to arrange the scope of the contract (the first hosting with the customer. Consultation on basic matters related to the contract with the customer) - Issuance of technical reports for business and design department;

3. Contract handling Composition - Contracts related to special control tower design work - calculation of response to the part in which pressure is pressure.
