1. The Defendant’s disposition of determining a disability grade against the Plaintiff on July 6, 2017 is revoked.
2. The costs of the lawsuit are assessed against the defendant.
Reasons
1. Details of the disposition;
A. On April 29, 2016, the Plaintiff received medical care approval from the Defendant as an injury or disease of “the head of a water unit 2, 3, 4, 5 water unit , cut 1, 2, 3, 4, and 5 water unit , the left side 1, 2, 3, 4, and 5 water unit , the upper right side 1, 1, 2, 3, 4, and 5 water unit , 1, 1, 1, 1, 1, 1, 1, 2, and 5 water unit , 3, 4, and 5 water unit , 1, 1, and 1,
B. After completing medical care, the Plaintiff filed a claim for disability benefits with the Defendant, and on July 6, 2017, the Defendant notified the Plaintiff of the determination that the Plaintiff’s disability grade constitutes class 6 (hereinafter “instant disposition”).

2. Whether the instant disposition is lawful
(a) Entry in the attached Form of relevant statutes;
B. Article 57(2) of the Industrial Accident Compensation Insurance Act provides that “Disability benefits shall be disability compensation annuities or lump-sum disability compensation benefits prescribed in attached Table 2 according to the grade of disability, and the criteria for disability grade shall be prescribed by Presidential Decree.” In accordance with the above delegation provision, Article 53(1) of the Enforcement Decree of the same Act provides that “the criteria for disability grade under Article 57(2) of the same Act
