1. Defendant A, B, C, and B shall be punished by a fine of KRW 3,00,00,000, and Defendant C shall be punished by a fine of KRW 1,50,000.

Punishment of the crime

Defendant

D is the representative director of H Co., Ltd. located in Seo-gu, Seocheon-gu, Chungcheongnam-gu, Chungcheongnam-do, and Defendant A is the chief in charge of personnel management, Defendant B is dispatched from the above company to the J Center located in Pyeongtaek-si, and is the director in charge of general distribution management, and Defendant C is the driver operating the land of the above company.

On June 5, 2012, K, an engineer of the above company, caused an accident of damage to loaded goods during the loading and unloading operation using the foreel vehicle.

However, according to Article 30 of the Korean Trucking Business Mutual Aid Association's clause, accidents that occur during the work of using machinery were excluded from insurance accidents.

Therefore, when the above accident was unable to receive insurance money from the Korea Trucking Financial Cooperative, the Defendants conspired to claim insurance money with false content as it was destroyed as Defendant C opened a wing for the operation of loading and unloading.

Accordingly, Defendant C signed documents necessary for the claim for the payment of insurance proceeds, and Defendant B received them from the mutual aid association, and Defendant A received false insurance accidents according to the plan by reporting it to Defendant D, and ordered Defendant D to receive the insurance proceeds as planned, and Defendant A did not receive insurance proceeds from the said association by deceiving the Plaintiff to receive the insurance proceeds in the way of claiming insurance proceeds from the said association on September 3, 2012, with the content that “C loaded the HECU ABS parts for vehicles (vehicle ABS parts) within the J Center located in Pyeongtaek-si I on June 5, 2012, upon arrival at the J Center and cancelling the operation at the J Center and closing the wing on the direction of the J Center, and caused damage due to the fall of the front wing.”
